I rarely disagree with Turley, but here I think that
Chief Judge Alex Kozinski got it right in writing the opinion. The right to free speech has to be balanced against misrepresentation that is damaging. There is no right of free speech to damage others through misrepresentation anymore that free speech covers yell "Fire!" in a crowded place with limited egress, and I don't understand how Professor Turley thinks otherwise. Liberalism is not "anything goes."
