If there’s any plaintiff’s law firm in America that should know racketeering when it sees it, it’s Cohen Milstein. It’s sued the major Wall Street banks repeatedly with a solid win rate for colluding to rig pretty much anything that trades. On Friday, in the same Federal District Court where its Wall Street actions are litigated, the Southern District of New York (SDNY), it filed its bombshell RICO lawsuit on behalf of the Democratic National Committee (DNC).

Secret side agreements are a common maneuver by corporate law firms. Here’s how they work. An agreement that is legal and passes the smell test is drafted and submitted to a court or a regulatory body for public consumption. Then, a separate, secret side agreement is written and signed by both sides and it contains all of the smelly, shady, ethically questionable hard details on how the original agreement will be carried out. 

Donna Brazile, the former interim Chair of the Democratic National Committee (DNC) during the 2016 presidential campaign, has written a new book, “Hacks: The Inside Story of the Break-ins and Breakdowns that Put Donald Trump in the White House,” and has revealed the secret side agreement that the DNC had with Hillary Clinton’s campaign....

This is how Brazile describes the secret side agreement in her book:

“The agreement—signed by Amy Dacey, the former CEO of the DNC, and Robby Mook [Clinton’s campaign manager] with a copy to Marc Elias [lawyer at Perkins Coie] — specified that in exchange for raising money and investing in the DNC, Hillary would control the party’s finances, strategy, and all the money raised. Her campaign had the right of refusal of who would be the party communications director, and it would make final decisions on all the other staff. The DNC also was required to consult with the campaign about all other staffing, budgeting, data, analytics, and mailings.”

The Clinton camp has now attempted to defend itself by saying these terms are standard because they were not going to kick in until the Democratic Party had chosen its official presidential nominee at its party convention in July 2016. But that’s not what the actual secret side agreement says. It indicates the following: “Beginning October 1, 2015,” the HVF would begin transferring $1.2 million to the DNC at the start of each month with that release “conditioned on” Hillary Clinton’s primary campaign personnel being consulted “and have joint authority over strategic decisions over the staffing, budget, expenditures, and general election related communications, data, technology, analytics, and research. The DNC will provide HFA advance opportunity to review on-line or mass email, communications that features a particular Democratic primary candidate.”

Additionally, the secret agreement states that “the DNC agrees that no later than September 11, 2015 it will hire one of two candidates previously identified as acceptable to HFA” (Hillary for America, the primary campaign fund for Clinton) as its Communications Director. All of this is occurring in the fall of 2015 with the official Democratic nominating convention not taking place until July 2016....

It gets worse.

The question that no one seems to be asking is who are the main beneficiaries of Perkins Coie’s heavy influence at the top of the Democratic Party. Despite Obama’s re-election for a second term, the Democratic Party shed nearly 1,000 seats from coast to coast. The Republicans now control both houses of Congress and the Executive Branch. A man with the lowest approval rating in modern history now occupies the Oval Office.

The primary beneficiaries of this hubris have been the 1 percent – Wall Street and hedge fund titans – and giant multi-national corporations that dominate the client roster at Perkins Coie.

Those within the Clinton camp and DNC who are suggesting to the American people that there is nothing to see here, time to move along, are dead wrong. Just because the Republican presidential campaign may have been corrupted by outside forces doesn’t mean that the Democratic campaign wasn’t also corrupted by its own outside forces. It’s time to follow the obscene political money trail wherever it leads.

And it was the Clinton New Democrats that brought in Perkins Coie in the first place.

After months of litigation, The DNC Fraud Lawsuit has been dismissed by Judge Zloch. Lawyers Jared and Elizabeth Beck have long cited deep corruption of the judicial system as a potential reason for the suit’s dismissal. The ruling comes as a blow to many former Bernie Sanders supporters who had hoped that the suit would address what many view as deeply seated corruption in the Democratic party establishment.

In his ruling, Judge Zloch wrote that the plaintiffs had failed to prove their injury, calling it “too diffuse” for Federal court. Despite the dismissal, Zloch did state that the court assumed the basic claim made by the plaintiffs to have been true; that the DNC acted against Bernie Sanders and in favor of Hillary Clinton despite outward claims of neutrality....

Somewhat ironically, as reports say that Paul Manafort's home was raided and numerous documents seized, The Hill reports, a watchdog group will file a complaint with the Federal Election Commission on Wednesday alleging that the Democratic National Committee (DNC) violated federal law by soliciting opposition research on the Trump campaign from a foreign government.

The conservative group Foundation for Accountability & Civic Trust (FACT), launched in 2014 by former U.S. attorney Matthew Whitaker, will allege that political operative Alexandra Chalupa, in her capacity as a DNC consultant, improperly sought intelligence on President Trump’s former campaign chairman, Paul Manafort, from Ukrainian officials....

Officials say she was freelancing and not representing the DNC in her efforts to gather information on Manafort.

I was wondering how long this would take. And we still don't have the story on the Trump dossier.

The White House defended interim Democratic National Committee Chairwoman Donna Brazile on Monday, amid accusations she sent debate questions to Hillary Clinton’s campaign when she was a CNN contributor.

“The president believes she has done a fine job stepping in, in a very difficult situation, to lead the Democratic Party,” White House press secretary Josh Earnest said.

When the Democratic National Committee announced its $32 million fundraising haul last month, it touted the result as evidence of “energy and excitement” for Hillary Clinton’s nomination for the White House and other races down the ballot. The influx of money, however, also owes in part to an unprecedented workaround of political spending limits that lets the party tap into millions of dollars more from Clinton’s wealthiest donors.

At least $7.3 million of the DNC’s July total originated with payments from hundreds of major donors who had already contributed the maximum $33,400 to the national committee, a review of Federal Election Commission filings shows. The contributions, many of which were made months earlier, were first bundled by the Hillary Victory Fund and then transferred to the state Democratic parties, which effectively stripped the donors’ names and sent the money to the DNC as a lump sum.

Of the transfers that state parties made to the DNC for which donor information was available, an overwhelming proportion came from contributions from maxed-out donors:

Congresswoman Tulsi Gabbard, vice chair of the Democratic National Committee, resigned on Sunday in order to endorse Democratic presidential candidate Bernie Sanders. Gabbard — who was the first Hindu and first American Samoan to be elected to Congress, as well as the youngest person ever elected to the Hawaii legislature, at age 21 — commended the leftist Vermont senator for his foreign policy, and his opposition to the hawkish policies of fellow presidential candidate Hillary Clinton. 

"After much thought and consideration, I've decided I cannot remain neutral and sit on the sidelines any longer," she wrote in an email to fellow DNC officers obtained by Politico. "There is a clear contrast between our two candidates with regard to my strong belief that we must end the interventionist, regime change policies that have cost us so much," Gabbard said. "This is not just another 'issue.' This is THE issue, and it's deeply personal to me," Gabbard continued. "This is why I’ve decided to resign as Vice Chair of the DNC so that I can support Bernie Sanders in his efforts to earn the Democratic nomination in the 2016 presidential race."

About those super-delegates:

Sanders’ campaign accused the DNC and Wasserman Schultz of “actively attempting to undermine” his bid for president.

In a Feb. 11 interview, Wasserman Schultz openly admitted that the Democratic Party’s superdelegate system, which consists of unelected party elites who have a large influence on the primary election, exists in order to ensure establishment candidates don’t have to run “against grassroots activists.”

CNN host Jake Tapper asked the DNC chair, “What do you tell voters who are new to the process who say this makes them feel like it’s all rigged?”

“Unpledged delegates exist really to make sure that party leaders and elected officials don’t have to be in a position where they are running against grassroots activists,” Wasserman Schultz explained.

“I’m not sure that that answer would satisfy an anxious young voter,” Tapper replied.
